Prazo de submissão inicia em 1º de julho.
No dia 1º de julho, iniciará o prazo para entrega da declaração que compõe o Censo Quinquenal de Capital Estrangeiro, organizado pelo Banco Central, para compilar estatísticas do setor externo relativas ao ano-base de 2020 (“Ano-Base”).
A participação é obrigatória para:
• Pessoas jurídicas sediadas no país, com participação direta de não residentes em seu capital social, em qualquer montante, no Ano-Base;
• Fundos de investimento com cotistas não residentes, no Ano-Base, por meio de seus administradores; e

• Pessoas jurídicas sediadas no país, com saldo devedor total de créditos comerciais de curto prazo (exigíveis em até 360 dias) concedidos por não residentes, em montante igual ou superior ao equivalente a US$ 1 milhão, no Ano-Base.
Em todos os casos, o Ano-Base considera a data de referência de 31/12/2020.
Não estão obrigadas à entrega do Censo Quinquenal: (i) as pessoas físicas, (ii) órgãos da Administração Pública Direta, (iii) pessoas jurídicas devedoras de repasses de créditos externos concedidos por instituições sediadas no Brasil e (iv) entidades sem fins lucrativos mantidas por contribuição de não residentes.
A submissão das informações deve ser efetuada no Sistema do Censo, no site do Banco Central do Brasil, até às 18h do dia 16 de agosto de 2021.
Em caso de não fornecimento ou de prestação de informações falsas, incompletas, incorretas ou intempestivas, os infratores ficam sujeitos às multas de 1%, 2% ou 10% do valor a ser registrado, limitadas a R$25.000,00, R$50.000,00 e R$250.000,00, respectivamente.

Period for submissions initiate on July 1st.
On July 1st 2021 begins the period of submission of the reports of the five-year census of foreign capital, conducted by the Central Bank of Brazil with the intent of compiling statistics on the foreign sector considering as its basis the year of 2020 (“Base Year”).
The participation in the census is mandatory for:
• Legal entities headquartered in Brazil with direct participation, in any amount, of non-residents in its capital on the Base Year;
• Investment funds with non-resident shareholders, through their managers, on the Base Year; and
• Legal entities headquartered in Brazil with a total outstanding balance of short-term commercial credits (payable within 360 days) granted by non-residents, in an amount equal to or greater than the equivalent of US$ 1 million on the Base Year.
In all cases, the Base Year considers its reference date as December 31st 2020.
The following entities are exempted from submission: (i) natural persons, (ii) direct administration agencies, (iii) legal entities that are debtors of transfers of foreign credits granted by institutions headquartered in Brazil, and (iv) non-profitable organizations maintained by contributions of non-residents.
The report shall be submitted to the Census’ System in the Central Bank’s website, until August 16th 2021, 6pm (BRT).
The non-compliance with the obligations or the submission of false, incomplete, incorrect or untimely information are subject to the penalty of 1%, 2% or 10% of the value to be registered, limited to R$ 25,000.00, R$ 50,000.00 e R$ 250,000.00, respectively.
